Welcome to Wish Mark ("App"). These Terms and Conditions ("Terms") govern your access to and use of the mobile application developed by KISHAN SUTHAR (VRAJ AI INDIA A Unit of VRAJ MOTORS)("we," "us," or "our").
By downloading, installing, or using Wish Mark, you agree to be bound by these Terms. If you do not agree, please uninstall and do not use the App.
1. Eligibility & Account Registration
- Business Use: This App is primarily designed for small businesses, MSMEs, and entrepreneurs to create marketing content.
- Accuracy: You agree to provide true, accurate, and current business information (Logo, Name, Phone Number,website,social TAG, Address) for your auto-branding features.
- Account Security: You are entirely responsible for maintaining the confidentiality of your device and account access.
2. In-App Wallet, Points, and Ad Rewards
To use most features of Wish Mark, you need to sign in with a valid email address via OTP or Google Sign-In. You are responsible for:
- Point System: Wish Mark utilizes a virtual point system for downloading and sharing high-resolution images. Points have no monetary value and cannot be exchanged for real cash.
- Earning Points: Users can earn points legitimately by watching third-party video advertisements inside the App.
- Purchasing Points: Users can buy point packs through authorized Google Play or Apple App Store billing. All sales are final and non-refundable.
- Abuse: Any attempt to manipulate, hack, or use automated scripts/bots to generate points without watching ads will result in an immediate permanent ban and forfeiture of all points.
3. Intellectual Property & Content Ownership
- App Content: All background templates, layouts, fonts, design assets, and multi-language quotes provided by Wish Mark remain our exclusive property.
- User Content: You retain ownership of any custom images and logos you upload. By uploading them, you grant Wish Mark a limited license to process and render them into posters for your personal or business use.
- Prohibited Content: You agree not to upload logos or images that violate third-party copyrights, trademarks, or contain offensive, political, or illegal material.
4. Fair Usage and Restrictions
You strictly agree NOT to:
- Decompile, reverse-engineer, or attempt to extract the source code of the App.
- Resell or redistribute the raw design templates provided in the App as your own standalone design assets.
- Remove any system watermarks or copyright notices unless unlocked via the proper consumption of points.
5. Disclaimer of Warranties
Wish Mark is provided on an "As-Is" and "As-Available" basis. While we strive to offer accurate festival calendars and text templates in English, Hindi, and Gujarati, we do not warrant that the App will be entirely error-free, uninterrupted, or that the graphics will fit every exact marketing requirement.
6. Limitation of Liability
To the maximum extent permitted by law, [Insert Your Name or Company Name] shall not be liable for any indirect, incidental, or consequential damages, including loss of business profits, data, or goodwill arising out of your use or inability to use the App.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal disputes shall be subject to the exclusive jurisdiction of the courts located in ANJAR, Gujarat INDIA.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of changes by updating the date at the top of this document. Continued use of the App after updates implies your acceptance of the revised Terms.
